Passive vs. Active: Why It Matters

The IRS treats rental and investment activity as passive by default — meaning losses can only offset passive income. But if you materially participate, those losses become active and deductible against wages, bonuses, and other ordinary income.

The 100-Hour Test

Under Reg. 1.469-5T, you materially participate if you spend at least 100 hours on the activity and no one else spends more time on it than you do. Because you own the panels or batteries outright — not through a fund — reaching 100 hours is straightforward.
